Zomyy Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Zomyy, operated by Zomyy Inc. (“Zomyy,” “we,” “us,” or “our”).

By using Zomyy, you agree to these Terms, our Privacy Policy, Community Guidelines, Copyright Policy, and any additional terms that apply to creators, purchases, or specific features.

1. What Zomyy Is

Zomyy is a food-focused creator platform for food videos, mukbang, food ASMR, cooking, recipes, restaurant reviews, food tastings, food travel, and related food content.

Zomyy is not an adult-content platform. Pornography, nudity, sexual services, sexualized food content, fetish content, and content intended primarily for sexual stimulation are prohibited.

5. User Content

You keep ownership of content you create, subject to the rights you grant Zomyy.

By uploading, posting, or submitting content, you grant Zomyy a worldwide, non-exclusive, royalty-free license to host, store, process, display, reproduce, adapt for technical formatting, distribute, promote, and make your content available through Zomyy.

This license allows us to operate the app, show your content to users, moderate content, create previews or thumbnails, recommend content, process reports, maintain backups, and comply with legal obligations.

Zomyy may review, restrict, remove, hide, demonetize, quarantine, or reject content or accounts at any time if we believe they violate our policies, create safety risks, violate law, infringe rights, or may cause App Store compliance issues.

We may use automated tools, human review, user reports, and backend safety checks.

7. Reports and Blocking

Users may report content, comments, profiles, messages, usernames, bios, copyright concerns, impersonation, and other violations.

Users may block other users. Blocking may limit interaction, visibility, comments, follows, messages, recommendations, and profile access.

Submitting false, abusive, or spam reports may result in account restrictions.

8. Purchases, Food Tokens, and Digital Access

Zomyy may offer Food Tokens purchased through Apple In-App Purchase.

Food Tokens may be used for:

Food Tokens are digital items used only inside Zomyy. They have no cash value, are not legal currency, are not stored value, and cannot be exchanged for cash by viewers.

All iOS purchases for digital content must be completed through Apple In-App Purchase.

Prices for token packages are displayed through Apple’s localized purchase system.

A Creator Pass provides access to eligible creator content for a fixed period shown at purchase. Creator Passes do not automatically renew unless a future feature clearly states otherwise.

Locked posts may be unlocked individually with tokens.

Tips are voluntary and do not unlock hidden content unless the app clearly states otherwise before purchase.

We may refuse, reverse, hold, or restrict transactions if required for fraud prevention, refunds, moderation, safety, legal compliance, account restrictions, or App Store requirements.

9. Refunds

Purchases made through Apple In-App Purchase are handled by Apple’s purchase and refund systems.

Zomyy may adjust token balances, Creator Passes, locked-post access, tips, creator earnings, or entitlements after refunds, reversals, chargebacks, fraud findings, content removal, moderation actions, or legal requirements.

10. Creator Features

Creators are subject to the Creator Agreement in addition to these Terms.

Zomyy may approve, reject, suspend, or remove creator access at any time.

11. No Guaranteed Income

Zomyy does not guarantee creators followers, views, purchases, tips, earnings, or payouts.

Estimated earnings may change due to refunds, reversals, Apple fees, platform fees, moderation holds, payout availability, tax requirements, fraud reviews, or account restrictions.

12. Intellectual Property

Zomyy owns or licenses its app, design, features, code, trademarks, logos, and branding.

You may not copy, scrape, reverse engineer, misuse, or create a competing service using Zomyy materials except as permitted by law.

You may not use another person’s copyrighted content, restaurant content, music, videos, photos, logos, or brand materials without permission.

13. Copyright Complaints

If you believe content on Zomyy infringes your copyright, follow the Zomyy Copyright Policy or contact support@zomyyy.com.

Zomyy may remove or restrict allegedly infringing content and may terminate repeat infringers.

14. App Store Terms

If you access Zomyy through an Apple device, Apple’s applicable App Store terms and purchase rules may also apply.

Apple is not responsible for Zomyy’ content, user content, support, moderation, creator payments, or disputes between users.

15. Disclaimers

Zomyy is provided “as is” and “as available.”

We do not guarantee that:

Zomyy is not responsible for food allergies, dietary restrictions, nutrition decisions, cooking safety, food handling decisions, or actions taken based on user content.

16. Limitation of Liability

To the maximum extent allowed by law, Zomyy and its owners, employees, contractors, partners, and service providers are not liable for indirect, incidental, special, consequential, punitive, or lost-profit damages arising from your use of Zomyy.

You agree to defend, indemnify, and hold Zomyy harmless from claims, losses, damages, liabilities, costs, and expenses arising from:

18. Account Suspension and Termination

We may suspend or terminate accounts or creator access if we believe a user has violated these Terms, Community Guidelines, Creator Agreement, law, safety requirements, App Store requirements, or the rights of others.

You may stop using Zomyy at any time.

You may request account deletion inside the app.

19. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will provide notice through the app, website, email, or another reasonable method.

Continued use of Zomyy after updated Terms become effective means you accept the updated Terms.
