Zomyy Creator Agreement

This Creator Agreement applies to anyone who applies to become, is approved as, or acts as a creator on Zomyy.
This Creator Agreement is part of the Zomyy Terms of Service. If there is a conflict between this Creator Agreement and the general Terms, this Creator Agreement controls for creator-specific matters.

1. Creator Eligibility
To become a creator, you must:
- Be at least 13 years old
- Have an Zomyy account in good standing
- Provide accurate creator application information
- Agree to the Zomyy Terms, Privacy Policy, Community Guidelines, Creator Agreement, and Copyright Policy
- Create only food-related content
- Own or have permission to use all content you upload
- Follow moderation and safety requirements
- Complete any payout, tax, or identity-verification requirements before receiving payouts, if payouts are enabled
Zomyy may approve, reject, suspend, or remove creator access at any time.
2. Food-Only Creator Content
Zomyy creators may post food-related content such as:
- Mukbang
- Food ASMR
- Cooking videos
- Recipes
- Baking
- Restaurant reviews
- Food tastings
- Food travel
- Kitchen behind-the-scenes content
- Food education
Creators may not post:
- Pornography
- Nudity
- Sexualized food content
- Fetish content
- Sexual services
- Sexual solicitation
- Content intended primarily for sexual stimulation
- Dangerous eating challenges
- Choking challenges
- Eating-disorder encouragement
- Harassment
- Hate speech
- Animal cruelty
- Illegal activity
- Copyright-infringing content
- Misleading paid content
- Off-platform prohibited promotion
3. Creator Application
Zomyy may require creators to complete an application before posting creator content or monetizing.
The application may request:
- Display name
- Username
- Bio
- Food specialties
- Profile image
- Cover image
- Content categories
- Age confirmation
- Agreement to creator terms
- Confirmation that your content is food-only
- Confirmation that you own or have rights to uploaded content
- Payout setup status
You may not approve yourself, misrepresent your identity, evade restrictions, or create a creator account for someone who is not eligible.
4. Content Rights
You keep ownership of content you create, subject to the rights you grant Zomyy.
By uploading creator content, you grant Zomyy a worldwide, non-exclusive, royalty-free license to host, store, process, display, reproduce, distribute, promote, moderate, create previews and thumbnails from, make technically necessary modifications to, and make your content available through Zomyy.
This license continues as needed to:
- Operate the platform
- Display content to users who have access
- Process reports
- Maintain purchase and entitlement history
- Comply with law
- Enforce policies
- Maintain backups
- Resolve disputes
- Support App Store and legal compliance
5. Content Ownership and Copyright
You represent that:
- You own your content or have permission to use it
- Your content does not infringe copyrights, trademarks, privacy rights, publicity rights, or other rights
- You have permission from anyone identifiable in your content
- You have permission to use music, logos, restaurant footage, brand materials, or third-party media included in your content
- You will not upload stolen videos, stolen photos, or unauthorized clips
Zomyy may remove content in response to copyright complaints and may suspend or terminate repeat infringers.
6. Moderation and Approval
Creator uploads may be reviewed before becoming public.
Zomyy may place content in one of several states, including:
- Draft
- Uploading
- Pending automated review
- Pending human review
- Approved
- Rejected
- Quarantined
- Removed
- Appealed
Content is not guaranteed to be approved.
Zomyy may reject, remove, restrict, or demonetize content if we believe it violates policies, safety standards, copyright rules, legal obligations, or App Store requirements.
Editing approved content may require additional review.
7. Creator Monetization
Zomyy may allow users to spend Food Tokens on creator-related digital features such as:
- Creator Passes
- Locked posts
- Tips
Food Tokens are purchased by users through Apple In-App Purchase inside the iOS app.
Revenue split. Apple's In-App Purchase commission is deducted first (15% under the App Store Small Business Program, otherwise 30%). When a user spends Food Tokens on your content — a Creator Pass, a locked post, or a tip — you earn 80% of the net value of those tokens and Zomyy retains a 20% platform fee. Zomyy may change this split on a forward-looking basis with notice.
Creator earnings shown in Zomyy are estimates unless and until payouts are fully configured, verified, reconciled, and available.
Estimated earnings may change because of:
- Apple fees
- Platform fees
- Refunds
- Reversals
- Fraud checks
- Moderation holds
- Copyright claims
- Tax obligations
- Payout-provider requirements
- Account restrictions
- Legal requirements
Zomyy does not guarantee any creator income, followers, purchases, tips, views, or payouts.
8. Payouts
Real cash payouts require payout-provider setup, identity verification, tax information, fraud review, legal compliance, and account approval.
Zomyy may hold, delay, reverse, or deny payouts due to:
- Refunds
- Chargebacks
- Fraud
- Copyright claims
- Policy violations
- Account restrictions
- Tax or legal requirements
- Missing payout setup
- Safety concerns
- Technical reconciliation issues
Do not rely on estimated earnings as final payout amounts.
You are responsible for taxes related to your creator activity.
9. Creator Conduct
Creators must:
- Treat users respectfully
- Follow the Community Guidelines
- Avoid misleading users about paid content
- Avoid directing users to prohibited external payment methods
- Avoid harassment or pressure tactics
- Avoid unsafe food behavior
- Avoid deceptive engagement practices
- Respond honestly during moderation and appeal processes
- Keep creator information accurate
Creators may not:
- Buy fake followers
- Manipulate engagement
- Evade moderation
- Use alternate accounts to bypass restrictions
- Encourage users to violate rules
- Sell access outside approved systems
- Promise content that is not delivered
- Misrepresent tips or paid access
10. Suspension and Termination
Zomyy may suspend or terminate creator status if:
- You violate the Terms
- You violate Community Guidelines
- You violate this Creator Agreement
- You infringe copyright
- You mislead users
- You create safety risk
- You fail identity, tax, or payout requirements
- Your account receives serious or repeated reports
- Required App Store or legal compliance is at risk
Termination may affect your profile, content visibility, monetization, estimated earnings, pending payouts, and access to creator tools.
11. Appeals
You may appeal certain moderation or creator-status decisions by contacting support@zomyyy.com.
Include:
- Your username
- The decision you are appealing
- The content involved, if applicable
- Why you believe the decision should be changed
- Any supporting information
Appeals do not guarantee reinstatement or payment.
12. No Employment Relationship
Creators are independent users of the platform. This Creator Agreement does not create an employment, partnership, joint venture, agency, franchise, or representative relationship between you and Zomyy.
13. Changes to This Creator Agreement
Zomyy may update this Creator Agreement. Continued creator activity after changes become effective means you accept the updated agreement.
